Default Termination Consulting Services

A termination for default is an extreme measure that places a contractor in a position where it may be exposed to re-procurement costs and other damages on the subject contract.  It may also affect a contractor’s standing with its surety for future work, or on a government contract where past performance is a consideration for new contracts.  Therefore the contractor’s response to a show cause or default notice requires diligent and careful scrutiny in its analysis, presentation and possible claim defense.

To prevail, or in some cases survive, a default termination situation the contractor must present an accurate, often immediate and precise response to any alleged grounds for default.  That response must infuse confidence in the owner, dispel accusations of questionable performance, and return objectivity to project.  PAI has assisted its clients in developing and presenting such responses in all areas of project controls and contractor performance in the construction industry.  Further, PAI has brought its project default and disputes experience to focus on those occasions where claims analysis, and testimony of that analysis, was required.
